Terms of Service

These Terms govern your use of the marketing website at edumagined.com. Use of the Edumagined platform itself is governed by a separate written Master Services Agreement between Edumagined and each school customer.

1. Acceptance

By accessing or using edumagined.com (the “Site”), you agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you do not agree, do not use the Site.

2. License to use the Site

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal or internal business purposes — for example, evaluating Edumagined as a potential vendor for your school. All rights not expressly granted are reserved.

3. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in a way that violates these Terms.
  • Scrape, crawl, or harvest data from the Site beyond what robots.txt permits, or attempt to circumvent rate limits or access controls.
  • Submit false, misleading, or fraudulent information through any form.
  • Reverse engineer, decompile, or attempt to derive source code from the Site.
  • Use the Site to transmit malware, spam, or content that infringes third-party rights.
  • Interfere with the operation, security, or integrity of the Site.
  • Use the Site to develop a competing product based on its content or structure.

4. Intellectual property

The Site, its content, design, logos, and code are owned by Edumagined or its licensors and are protected by copyright, trademark, and other intellectual property laws. “Edumagined” and the Edumagined logo are trademarks of Edumagined. Third-party names, logos, and trademarks referenced on the Site (including competitor names in our comparison pages) are the property of their respective owners and are used for identification and comparative purposes only; their inclusion does not imply endorsement, sponsorship, or affiliation.

5. Submissions and inquiries

When you submit a form, you confirm that the information is accurate and that you have authority to provide it (including any school or employer information). We handle submissions per our Privacy Policy. We may decline to respond or to do business with any submission at our discretion.

6. No professional advice

Content on the Site — including pricing examples, TCO calculations, comparison tables, case study figures, and module descriptions — is provided for general informational purposes only and does not constitute professional, legal, financial, or compliance advice. Comparison tables reflect publicly available information and our best understanding at the time of publishing; actual competitor capabilities may change. Pricing examples are illustrative and any actual commercial offer will be made in a written agreement.

7. Third-party links and services

The Site may link to or embed third-party services (for example, scheduling calendars). We are not responsible for the content or practices of third-party sites or services. Your use of them is governed by their own terms and policies.

8. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. Some jurisdictions do not allow the exclusion of certain warranties; in those cases, the exclusion applies to the maximum extent permitted by law.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDUMAGINED AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED USD $100.

10. Indemnification

You agree to indemnify and hold Edumagined harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws principles. Any dispute relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of those courts.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date above. Your continued use of the Site after a change constitutes acceptance.

13. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections that by their nature should survive termination (IP, disclaimers, limitations, indemnity, governing law) will survive.
